Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Withdrawal period: the period during which the consumer may exercise the right of withdrawal;

  • Consumer: the natural person who is not acting for purposes relating to a trade, business, craft, or profession and who enters into a distance contract with the merchant;

  • Day: calendar day;

  • Continuous performance contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

  • Durable medium: any means that enables the consumer or the merchant to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

  • Right of withdrawal: the consumer’s option to withdraw from the distance contract within the withdrawal period;

  • Merchant: the natural or legal person who offers products and/or services to consumers at a distance;

  • Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, where exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;

  • Means of distance communication: any means that can be used to conclude a contract without the consumer and merchant being physically present in the same place at the same time;

  • Terms and Conditions: these Terms and Conditions of the merchant.

Article 3 – Scope of Application

These Terms and Conditions apply to every offer made by the merchant and to every distance contract concluded between the merchant and the consumer. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated prior to the conclusion of the contract that the Terms and Conditions can be consulted and will be sent free of charge upon request. If the contract is concluded electronically, the Terms and Conditions may be provided electronically in a way that allows storage on a durable medium. If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may rely on the provision most favorable to them. If one or more provisions are invalid, the remaining provisions remain in force and the invalid provision will be replaced by one that most closely reflects the original intent.

 

Article 4 – The Offer

If an offer is subject to limited validity or conditions, this will be expressly stated. All offers are non-binding and may be modified or withdrawn. Offers include a complete and accurate description of the products and/or services. Images are representative but may differ slightly from the actual product. Obvious errors do not bind the merchant. Prices are exclusive of any import duties or taxes that may apply, which are the responsibility of the customer unless stated otherwise. Each offer clearly states pricing, shipping costs, contract formation, payment and delivery terms, withdrawal rights, contract language, duration, and available variations.

 

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions. Electronic acceptance is confirmed electronically. Until confirmation is received, the consumer may cancel. Secure systems are used for data transfer and payments. The merchant may assess payment capacity and refuse or condition orders if justified. Required information will be provided at or before delivery. All contracts are subject to product availability.

 

Article 6 – Right of Withdrawal

The consumer has a right of withdrawal only if and to the extent that applicable local or federal laws require it or as expressly provided in the merchant’s returns or refund policy. Any such right and applicable period will be clearly communicated to the consumer at or before the time of purchase. Products must be handled carefully and returned in original condition if returns are permitted. The consumer must notify the merchant within any specified period and return the product within any additional period specified, providing proof of shipment where required. Failure to comply with the stated procedures may make the sale final, subject to applicable law.

 

Article 7 – Costs in Case of Withdrawal

If a right of withdrawal applies, any return shipping costs and other costs will be handled in accordance with the applicable law and the merchant’s stated policy. Refunds will be processed in the timeframe required by applicable law, provided the product or proof of return is received.

 

Article 8 – Exclusion of the Right of Withdrawal

Where permitted or required by law, the right of withdrawal may be excluded for certain categories such as custom-made or personalized products, perishable goods, hygiene products once opened, sealed media once unsealed, products subject to market fluctuations, and certain services provided on specific dates or already started with consent. Exact exclusions depend on applicable law and will be stated where required.

 

Article 9 – Price

Prices will not increase during the stated validity period except due to legal changes. Delivery may occur across borders and import charges may apply upon delivery where relevant. Prices are subject to typographical errors; in such cases the merchant reserves the right to correct the pricing or cancel the order if the error is obvious.

 

Article 10 – Conformity and Warranty

Products comply with the contract and applicable standards. Manufacturer warranties do not affect statutory rights where they apply. Defects must be reported within any timeframe required by applicable law or the merchant’s warranty policy. Warranty excludes misuse, unauthorized modifications, or abnormal conditions not covered by the warranty.

 

Article 11 – Delivery and Performance

Orders are handled with care and delivered to the address provided. Delivery occurs within a reasonable time and no later than any period agreed upon, unless otherwise agreed. In case of delay or non-performance, the consumer may cancel and receive a refund to the extent permitted by applicable law. Risk transfers upon delivery as defined by the relevant law or shipping terms.

 

Article 12 – Continuous Performance Contracts

Indefinite contracts may be terminated at any time with one month’s notice if allowed under the contract and applicable law. Fixed-term contracts are not automatically renewed unless stated.

 

Article 13 – Payment

Payments must be made within the timeframe stated in the contract unless otherwise agreed. Errors in payment details must be reported immediately. Reasonable costs may be charged in case of non-payment, where permitted by law.

 

Article 14 – Complaints Procedure

Complaints must be submitted within any timeframe required by applicable law or the merchant’s stated policy and are handled within any specified timeframe. Valid complaints may result in repair, replacement, or refund as appropriate under the warranty or consumer protection rules.

 

Article 15 – Disputes

All agreements are governed by the laws applicable to the merchant and the purchase, which may vary by jurisdiction. Consumers should be informed of the governing law and any applicable dispute resolution procedures.

 

Article 16 – CESOP

Where applicable, payment service providers may be required to report transaction data under regulations such as CESOP or other reporting obligations. The merchant complies with applicable reporting requirements.
